DMCA & Abuse Policy

Fxolio LLC responds to copyright notices and abuse reports concerning traffic that exited one of our servers. This page explains what we can and cannot do, and how to reach us.

What we can do

Teal VPN is a conduit: traffic passes through our servers without being stored, logged or inspected. Because we keep no record of which subscriber connected to which destination, we cannot identify the user responsible for a particular connection, and we cannot remove content that is not hosted by us. We do not host user content.

What we can do is act on the account or the server: investigate the report, suspend accounts that breach our Terms of Service, and cooperate with valid legal process binding on us.

Sending a copyright notice

To be effective under 17 U.S.C. § 512(c)(3), your notice must include:

• a physical or electronic signature of the copyright owner or a person authorised to act for them;
• identification of the copyrighted work claimed to have been infringed;
• identification of the material claimed to be infringing, with enough detail for us to locate it — including the IP address, the port, the timestamp, and the time zone;
• your address, telephone number and email address;
• a statement that you have a good faith belief the use is not authorised by the copyright owner, its agent, or the law;
• a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on the owner’s behalf.

Notices without a timestamp and time zone cannot be acted on, because they cannot be matched to anything.

Counter-notice

If your account was suspended over a notice you believe was mistaken, send a counter-notice to abuse@tealvpn.com containing your signature, identification of the material, a statement under penalty of perjury that you have a good faith belief it was removed by mistake or misidentification, and your consent to the jurisdiction of the United States District Court for the district in which you live, or if you live outside the United States, any district in which we may be found.

Repeat infringers

We terminate the accounts of subscribers who are repeat infringers in appropriate circumstances.

Other abuse

Reports of spam, network attacks, scanning or fraud should also go to abuse@tealvpn.com. Please include IP address, port, timestamp and time zone, plus any relevant log excerpt. We act on credible reports and, where a breach of our terms is established, suspend the account responsible.

Law enforcement

Requests must be served on Fxolio LLC through valid legal process. We will respond to what we actually hold, which is set out in our Privacy Policy. We cannot produce browsing history or traffic contents, because those records do not exist.
